Windflower Piercing Studio provides professional body piercing services and sells fine jewelry suitable for piercings. All services are performed by trained and experienced professionals in compliance with California health and safety regulations.

3. Age Requirements and Parental Consent

Minors under 18 years of age must be accompanied by a parent or legal guardian and must provide valid government-issued identification for both the minor and the parent/guardian. Certain piercings may have additional age restrictions in accordance with California law and our studio policies.

We reserve the right to refuse service to any individual at our sole discretion, including but not limited to concerns about the minor's maturity, health conditions, or appropriateness of the requested piercing.

4. Health and Safety Requirements

By receiving services, you represent and warrant that:

• You are in good general health and not under the influence of drugs or alcohol

• You have disclosed all relevant medical conditions, allergies, medications, and health concerns

• You are not pregnant or breastfeeding (certain piercings may be restricted)

• You do not have any conditions that would contraindicate piercing services

We reserve the right to refuse service if we believe proceeding would pose health or safety risks.

5. Appointments and Cancellations

Appointments can be scheduled through our Website or by phone. No-shows will result in forfeiture of any deposit paid and may affect your ability to book future appointments.

We reserve the right to reschedule or cancel appointments due to unforeseen circumstances. In such cases, we will make reasonable efforts to notify you and offer alternative appointment times.

6. Payment Terms

We accept the following payment methods:

• Visa, Mastercard, American Express, and Discover

• Cash

Payment is due at the time of service. All prices are subject to applicable California sales tax. Prices may change without notice, but you will be informed of the total cost before service is rendered.

Deposits, when required, are non-refundable but may be transferred to a future appointment with sufficient notice.

7. Product Sales and Jewelry

All jewelry and products sold are carefully curated for quality and safety. We make every effort to accurately display colors, materials, and specifications on our Website, but we cannot guarantee that your device will accurately reflect product appearance.

While we take every precaution to ensure safe and professional services, you acknowledge that body piercing carries inherent risks including but not limited to infection, allergic reaction, scarring, and migration or rejection of jewelry. You assume these risks voluntarily.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Informal Resolution: Before filing any legal action, you agree to first attempt to resolve any dispute informally by contacting us at WindflowerPiercing@yahoo.com. We will attempt to resolve the dispute informally within 30 days.

Arbitration: If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in San Bernardino County, California.

Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND WINDFLOWER PIERCING STUDIO INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Exceptions: Either party may seek equitable relief in court to protect intellectual property rights or seek enforcement of this arbitration agreement.

17. Termination

We may terminate or suspend your access to the Website and services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Website will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
